01. Acceptance of these terms
These terms govern your use of Oobital and the oobital.com website. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
We may update these terms as the product evolves. When we make a material change we will update the date above and, where appropriate, give you notice before it takes effect. Continued use after a change takes effect constitutes acceptance.
02. What Oobital is
Oobital is software for managing a social presence across ten connected platforms. It provides a composer, a scheduling calendar, a media library, an AI drafting layer, and unified analytics.
Oobital is a tool. It does not create an agency-client relationship with the platforms you connect, it does not guarantee reach or engagement, and it makes no representation about the results of anything you publish through it.
03. Accounts
You must provide accurate registration information and keep it up to date. You are responsible for activity under your account and for keeping your credentials secure.
You must be old enough to enter a contract where you live, and you may not create an account on behalf of someone else without their authority.
You can close your account at any time. On closure we delete your data as described in the Privacy Policy.
04. Connecting platform accounts
You may connect social platform accounts that you own or that you are authorized to administer. You grant Oobital access through each platform's own authorization flow, and you may revoke that access at any time.
You are responsible for everything published through your connected accounts, including content published by anyone you grant workspace access to. Publishing activity is logged against your workspace.
Each platform governs your account independently, including its terms of service, rate limits, and acceptable-use rules. Oobital is not a substitute for complying with them.
- Oobital publishes only to platforms you have connected and only while access remains granted.
- Revoking access stops future publishing immediately. Scheduled posts that have not published will not publish afterwards.
- We may suspend or disconnect a connection where we reasonably believe it is compromised or is being used to violate a platform's terms.
05. Your content
You retain all rights to the media you upload and the content you compose. Oobital claims no ownership of your content.
You grant Oobital a limited license to host, copy, transmit, transcode, and display your content solely to provide the service, for example generating platform-sized variants of a video and delivering a scheduled post.
That license ends when you delete the content or close your account, except for copies still required by law or held in backups on the documented deletion schedule.
06. AI-drafted content
The AI drafting layer produces drafts from material you submit. You own what you submit and what you choose to publish from the output.
Output is generated automatically and may be inaccurate, generic, or similar to output produced for another customer. You must review and edit drafts before publication.
You are responsible for compliance with any rule that applies to AI-assisted content on the platform where you publish, including disclosure requirements and advertising rules. We do not review your content for you and we do not accept liability for content you publish.
07. Acceptable use
You agree to use Oobital only for lawful purposes and in a way that respects the rights of others.
- Do not publish content that is unlawful, infringing, defamatory, hateful, or that depicts the exploitation of children or sexual violence.
- Do not publish misleading content, impersonate another person or organization, or conduct deceptive practices such as undisclosed advertising or engagement manipulation.
- Do not attempt to disrupt, probe, reverse engineer, or gain unauthorized access to the service or its infrastructure.
- Do not scrape, crawl, or bulk-extract the service without prior written authorization.
- Do not resell, sublicense, or provide the service to a third party as a standalone service.
08. Plans, billing, and cancellation
Paid plans are billed in advance on a recurring monthly cycle. Usage limits, included features, and storage allowances are set out on the pricing page and in your workspace.
You may upgrade or downgrade at any time. Upgrades take effect immediately and are prorated; downgrades take effect at the start of the next cycle.
You may cancel at any time. Cancellation takes effect at the end of the current billing period, and we do not charge a cancellation fee.
Except where required by law or set out on the pricing page, fees already paid are non-refundable. Refund requests are considered individually. Contact us and we will resolve them promptly.
If a payment fails and is not resolved, we may suspend publishing and scheduled posts after giving you notice and a reasonable opportunity to update your payment details.
09. Third-party platforms
Oobital depends on APIs, interfaces, and policies operated by third-party social platforms. We do not control them.
A platform may change, restrict, or withdraw access at any time, and may suspend an account you connected. Where that happens outside our reasonable control, we are not liable for the resulting loss of service.
10. Availability
We work to keep the service available but do not guarantee uninterrupted operation. Scheduled maintenance, platform-side failures, and events outside our reasonable control may cause downtime or delays.
11. Suspension and termination
You may stop using the service and close your account at any time.
We may suspend or terminate access where we reasonably believe you have breached these terms, where an account is compromised, or where required by law. Where we can, we will warn you and give you a chance to resolve the issue first.
On termination your data is handled as described in the Privacy Policy. Clauses that by their nature should survive termination, including ownership, disclaimers, and liability limits, do survive.
12. Disclaimer of warranties
The service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or that any generated content will be accurate or suitable for publication.
We do not warrant that the service will improve your reach, engagement, or revenue.
13. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill, or data, arising out of these terms or your use of the service.
To the maximum extent permitted by law, our total aggregate liability is limited to the fees you paid Oobital in the three months immediately before the event giving rise to the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
14. Indemnity
You agree to indemnify Oobital against claims, damages, and reasonable costs arising from content you publish through the service, from your breach of these terms, or from your violation of a connected platform's rules.
15. Governing law
These terms are governed by the laws applicable at our contracting entity, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections available to you where you live.
